Welcome to the Duckweed Labs website (the “Site”), owned and operated by Duckweed Labs (“Duckweed Labs,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our Site and any services provided through it. By accessing or using the Site, you agree to be bound by these Terms.   2. Duckweed Labs has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

  3. You acknowledge and agree that Duckweed Labs shall not be liable or responsible for any damages or losses caused by or in connection with the use of or reliance on any content, goods, or services available on or through such third-party sites or services.

 

6. Disclaimer of Warranties

  1. Site Provided “As Is”: The Site and all information, content, materials, and services available on or through it are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied.

  2. No Warranty: Duckweed Labs does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on the Site or otherwise relating to such materials or on any sites linked to this Site.

  3. No Liability: To the maximum extent permitted by applicable law, Duckweed Labs disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

 

7. Limitation of Liability

No Indirect Damages: In no event shall Duckweed Labs, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use or inability to use the Site.

  2. Cap on Liability: To the maximum extent permitted by applicable law, Duckweed Labs’ total liability for any claim arising out of or relating to these Terms or your use of the Site shall not exceed the amount paid by you, if any, for accessing the Site.

  3. Basis of the Bargain: The limitations of liability set forth in this section are fundamental elements of the basis of the bargain between you and Duckweed Labs.

 

8. Indemnification

You agree to indemnify, defend, and hold harmless Duckweed Labs and its directors, officers, employees, affiliates, agents, contractors, and licensors from and against any and all claims, damages, liabilities, costs, and expenses (including attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of another.

10. Governing Law and Jurisdiction
